Meeting Notes: As of 10-18-2023, the HOA had two more residents take advantage of the one-time mailbox repair program for this year. If you are interested in participating in the program for 2023, please email director@whispercreeknorthhoa.com. Refer to the November 9, 2022, board notice for full details. Please remember residents need board approval prior to the beginning of any mailbox work to be considered for reimbursement. Reimbursement takes approximately two to three weeks.
b. AMENDMENTS AND BY-LAWS TO BE VOTED ON (JIM)
Meeting Notes: Jim outlined the two items to be voted on. Voting to take place next Tuesday October 24, 2023, at a non-board member residents’ garage in Whisper Creek North from 5 PM to 7 PM. The two items to be voted on are the proposed changes to our current amendments and the addition of by-laws. The 10-page packet was mailed to each lot/resident on September 15, 2023.

a. ATTORNEY PROGRESS (JIM)
Meeting Notes: Jim provided an update with HOA’s ongoing discussion with WCN new attorneys recommended by Foxborough Estates and thus far, the HOA is happy with their overall communication and services. This firm specializes in HOA laws, rules, etc. The Board objective here is to condense and remove old jargon (removal of builder’s names, etc.), and also insure our 2007 declarations, the 2011 amendments are properly documented as well as up to date with respect to any new amendments, rules and regulations, other missing criteria/laws to protect WCN as of 2023. WCN currently does not include any bylaws for the Board. Certain changes require a resident vote and there will also be an additional fee to make all of the aforementioned up to date. This is a work in progress and there are still outstanding questions to be answered by the law firm. More to come on this situation once finalized.
b. SIGN EXPLORATION (GREG)
Meeting Notes: Greg mentioned the contacting of the three contractors who built Whisper Creek, Ginger Creek, and Foxborough monuments. Initial calls and emails were sent off requesting quotes. However, there have been zero RFQs received back from any signage company. However, with the continual delay of Boulder Ridge P4, the building of the monument is not a priority but obtaining an estimate is still a goal so WCN can evaluate the cost and decide the next move. Greg will continue to work on this project.
c. MAILBOX REPAIR PROGRAM UPDATE (JEAN)
Meeting Notes: As of 4-19-2023, four residents have already signed up to utilize the program. However, only one resident has taken advantage of the program as of July 19, 2023. The board will reevaluate the program at the end of the year and determine if it should continue for 2024.
d. 2023 POND/COMMON GRASS MAINTENANCE (JIM)
Meeting Notes: Pond and common areas are handled by the Village of Mokena (VOM) who contracted McCloud for testing and maintenance. Beary Landscaping was contracted by the VOM to maintain the mowing around the pond and common areas. WCN HOA has asked Beary to flag areas after treatments.
e. 2023 TREE REPLACEMENTS (JEAN)
Meeting Notes: Two trees were replaced by the Village of Mokena. The board expressed the importance of hearing from WCN residents (communication) of any issues they see on common areas.
f. FLOCK SYSTEM INVESTIGATION UPDATE (JIM)
Meeting Notes: ZERO response back from the company after a board zoom meeting. The board reached out several times to no avail. Too many questions and concerns with no answers to proceed at this time.
g. RED LIGHT ON STOP SIGN (JEAN)
Meeting Notes: The Village of Mokena provided/installed ONE flashing red light at the stop sign heading north bound at the corner of Whisper Creek Way and Hillcrest Drive. This was after the HOA contacted the Village about painting white lines at each stop sign in the neighborhood as well as markings and or signage the bike / walking trail just south of the bridge entering into Whisper Creek North subdivision.
8. OPEN SESSION FOR RESIDENT COMMENTS (GREG) 7:40PM TO 7:5PM

1 – Several residents on zoom call expressed concern that the flashing red light on one stop sign was not working at all. It appears WCN vehicles as well as delivery vehicles are speeding throughout the sub-division and rolling through the stop signs. Individuals are driving in the streets on e-bikes, etc. Not safe.
2 – Resident expressed concern of a temporary pool and temporary fence in Whisper Creek South, and they are allowed above ground pools but the VOM does require a permanent fence.
3 – Whisper Creek South still does not have a HOA and is currently being run by Barb with Hartz. Jim spoke with a few of the south residents in May and offered any help if need be but as of now the forming of a South HOA will be announced through the VOA first then proceeding with an election.
4 – Whisper Creek townhome situation was discussed; is available to WCN residents via Zoom recording.

Meeting Notes: After the financials were read, several WCH residents expressed concern about why the townhomes annual cost exceeds their budget and the 110% cap allowed stated within the covenants. The WCN board recognized the residents’ concern and stated the issue will be addressed appropriately.
b. NEW ATTORNEY SELECTION (JIM)
Meeting Notes: The WCH Board shared their findings on retaining new legal counsel who specializes and whose primary clientele are HOAs. This allows their firm to be competitive and also allows us to utilize their expertise in this field. During the board’s interviewing process, we learned they also represent a few other HOAs in the area. A motion to proceed with the new law firm was read aloud and approved by the WCH board during the meeting.

Meeting Notes: HOA retained the contact information for the three contractors who built Whisper Creek, Ginger Creek, and Foxborough monuments. An initial call and emails were sent off requesting a quote. When received, a survey will be emailed out with the different renderings and costs associated with it.
d. STAGERING OF BOARD TERMS (JIM)
Meeting Notes: A rotating 3-year HOA term where every year an election would take place for only one of the board positions to be voted on by the residents. This format would allow for smoother transitions and continuous forward progress to remain intact within the HOA Board.
e. MAILBOX REPAIR PROGRAM UPDATE (JEAN)
Meeting Notes: As of 4-19-2023, four residents have already signed up to utilize the program.
f. 2023 POND GRASS MAINTENANCE (JIM)
Meeting Notes: HOA asked Beary Landscaping for proof of insurance and discussed their responsibility.
g. SOUND WALL UPDATE (JIM)
Meeting Notes: Not a good update here. Jim was recently informed by Will County and the State of Illinois that they are not looking to do anything at this time. Jim had also then reached out to the Village of Mokena who stated it was out of their hands/control. This is very unfortunate as several WCN residents expressed the importance of a sound wall and it was heard loud and clear by your HOA.
h. COMMON AREA (JIM)
Meeting Notes: The Village of Mokena own communal areas. Therefore, anything planted, or items placed in public areas are prohibited.
i. NEW RESIDENTS (JEAN)
Meeting Notes: Please welcome our new neighbors on lots #43, #55, and #61. There are three remaining lots, #23 and #6; both are currently under construction and lot #62 which is already sold. WCN will soon be fully occupied!

1 Resident expressed concern of what is allowed on a property while building is under construction, referring the box container / trailer recently placed on a lot.
2 – Resident expressed the ongoing concern of the 199-acre property to the West of our sub-division. It was identified there is a deer-stand in a tree, continually see bonfires, trucks, and hear gunshots coming from the property. The Board recommended to continue calling the Will County police when he or anyone else sees or hears anything happening.
3 – Resident expressed concern of a standard clean up procedure around the pond, overgrown plants, cattails, etc. by the Village of Mokena.
4 – Resident expressed concern about the ongoing ATV issue on the east side of the subdivision. The Board recommended to continue calling the Mokena Police and the Village of Mokena when anyone sees or hears anything happening.

Meeting Notes: The Village of Mokena has no copy of the original annex for WCN signage. Two forms must be completed, submitted, and approved by the Village before the WCN residents can vote on a design, cost, etc.
b. SURVEY READOUT (JIM)
Meeting Notes: Great participation and feedback from WCN residents who responded to the Survey Monkey. WCN HOA we will be utilizing this communication platform moving forward.
c. MAILBOX REPAIR PROGRAM (JEAN)
Meeting Notes: WCN HOA directors has approved a ONE-TIME, per mailbox, up to a maximum of $250.00 per mailbox replacement/repair rebate to homeowners who submit by email to director@whispercreeknorthhoa.com with their replacement / repair receipt. Homeowners MUST obtain authorization from Whisper Creek North HOA prior to contracting repairs of your mailbox. The Board has budgeted $2,500.00 for the budget of 2023, allowing for replacement/repairs of 10 mailboxes for the year. To clarify, labor done by homeowner will not be reimbursed, however, payment to an outside contractor can be included and will be reimbursed up to the maximum of $250.00.

Meeting Notes: Jim and Mychal discussed both ponds especially the one pond in the NW corner of sub.
e. SOUND WALL UPDATE (JIM)
Meeting Notes: Major concern from residents. Jim is working with the state via email. This process will take some time but the importance of it was heard loud and clear by the HOA.
f. DISCUSSION OF RULES AND REGULATIONS REFINEMENT (JIM)
Meeting Notes: Now that WCN home building is 99% completed, the HOA has drafted a condensed version of the rules and regulations. The goal of this redefined document is to make it easier for homeowners to review rather than having to read through the entire the original document. Please note, this refined document does not supersede the original rules and regulations.

1 - Resident complimented the board HOA and their time and effort spent on these topics.
2 - The 199-acre property to the West of our sub-division was discussed. It is owned by Big Farms and is currently listed on the market for $5.5 million. Much of the property is unbuildable.
3 – Boulder Ridge Phase 4 was discussed. There was a job shutdown, but Jean did confirm there are new investors and construction will restart in Spring of 2023.

-The Quarterly / Annual meetings will be changed to Annual meetings only going forward
-Informed residents to please continue to contact the Board of Directors thru the HOA Web page and not text to individual board members so that all board members will be aware of requests and comments about WCN
*Residents were asked to please use the WCN Facebook page to notify other residents of anything going on in the neighborhood activities wise or other. Also, to let the board know of any ideas / suggestions they may have for the board to consider and get accomplished.
*Treasurer gave an up-to-date financial report
-67 lots have been collected from for the annual HOA dues
-Was announced that no financial statements will be disclosed publicly but are available upon request
*Board discussed ideas of how money could possibly be spent on in WCN
-Monuments or hand-crafted wooden signage at the entrances of WCN by the bridge and the new phase being developed.

*Discussions about the new management company for the Townhome Association hired as opposed to the old company which was very hard to deal with and the expenses we incur from them on a yearly basis.
-The complete area occupied by the Whisper Creek Subdivision is divided up as WCN is 51%, WCS is 37%, WC Townhomes is 22%. Based on the percentages it would seem that WCN should be in charge of the South entrance monument area expenses.

-Rules & Regulations from the village discussed from last meetings notes
-President was trying to explain to a resident on how we cannot / hard to change the covenants that we were given. Proceeded to remind the resident that all Village rules. Regulations and ordinances supersede any of the WCN HOA covenants.
-Once any changes are made to the CCR’s and then approved and finished by the HOA lawyer, the Cook County board and the State of Illinois a postcard will be sent out of any and all covenants on it and mailed to the residents of WCN.
-Non compliance penalties were questioned to the board by a resident. The reply was that we are waiting for our lawyer to get back to us on his final review and approval in a much timelier manor than what has been going on.

-There are 4 vacant lots left. 2 have been approved to be built on.
-HOA Board Election year brought up by the Pres
-Please email the board any notice of intent to run for a position on the board by June 30th
-Election will be held on Tues August 16th at 19053 Whisper Creek Way in the garage starting at 6pm ending at 8pm
*Also, the board will be posting Election info on the WCN Facebook page with all the info needed.
***PLEASE, ANY ABSENTEE BALLOTS NEEDED MUST BE SUBMITTED BY 12PM SUNDAY AUGUST 7th THRU THE HOA WEBSITE. NO EXCEPTIONS
-Shorter / Longer / Alternating Terms brought up as a possibility in the future.
-The walkways at the bridge that are sunken down are now on the Villages schedule to be raised or fixed or replaced soon in the Fall of 2022 after bids are all received and approved by the Village Board
-Mail boxes that are leaning or are in need of repair may be able to be fixed / replaced by a new guy TBD. Details to follow.
-ATV discussion once again was brought up. Possible deterrents are speed bumps to be placed on streets. Police participation increased, if possible, in controlling the ATV traffic coming from Phase 4 of Boulder Ridge in the NE part of WCN.
